In late 2009, the United States Court of Appeals for the Federal Circuit held in Forest Group, Inc. v. Bon Tool Company that the patent false marking statute, 35 U.S.C. § 292, requires courts to assess fines for false marking on a per article basis. While historically few patent cases have included patent marking claims, the Federal Circuit decision has led to a dramatic number of cases.
This program will examine the background of the case and decision, analyze recent trends in case filings, and offer practical considerations to help ensure compliance with the statute and to minimize the risk of liability for false marking.
